Acceptance of Terms

By accessing this website or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use our website or services.

We reserve the right to update or modify these terms at any time without prior notice. Your continued use of the website following any changes constitutes acceptance of the revised terms.

Use of Website

You agree to use this website only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use and enjoyment of the site. You may not:

• Use the website in any way that violates applicable federal, state, or local laws
• Attempt to gain unauthorized access to any portion of the website or its systems
• Use automated tools (bots, scrapers, crawlers) to access or collect data from the website without our written permission

Bookings, Reservations & Cancellations

Reservations

All reservations are subject to availability and confirmation. A reservation is not guaranteed until you receive written confirmation from us. We reserve the right to decline any reservation at our discretion.

The primary guest making the reservation must be at least 21 years of age and must be present for the duration of the stay.

Pricing & Payment

All rates are quoted in U.S. dollars and are subject to applicable taxes, fees, and surcharges. We reserve the right to correct pricing errors. Full payment or a deposit may be required at the time of booking, depending on the reservation type.

Cancellation Policy

• 50% Refund: Guests who cancel 30 or more days before check-in will receive a 50% refund of the nightly rate, including all fees.
• No Refund: Guests who cancel less than 30 days before check-in or depart early will be charged the full rate.

We strongly recommend purchasing travel insurance for your trip. Specific cancellation terms may vary for events, group bookings, and long-term stays, and will be provided at the time of booking.

Check-In & Check-Out

• Check-in: After 4:00 PM local time
• Check-out: Before 10:00 AM local time

Early check-in or late check-out may be available upon request and is subject to availability. Late checkout without prior approval may result in a fee of up to one night's rental.

Occupancy

The number of guests staying in a unit cannot exceed the maximum occupancy listed for that unit type. All guests must be registered at the time of booking. Undeclared guests may incur a fee of $50 per person per day.

Property Rules

Quiet Hours

Quiet hours are from 10:00 PM to 7:00 AM. Please be respectful of other guests and neighboring properties. Apple Mountain Resort is a family-friendly property in a mountain community.

Smoking Policy

No smoking, vaping, or use of illegal substances is permitted anywhere on the property, including inside units, on patios, balconies, or common areas. Violation of this policy will result in a cleaning fee of up to $300.

Pet Policy

Pets must be pre-approved at the time of booking. Only house-trained pets under 50 pounds may be considered. A pet fee will be agreed upon based on your pet's specifics. Unapproved pets or violations of pet rules may result in fees up to $100 per incident.

Service animals are welcome and are not subject to pet fees. Please inform us at the time of booking.

Golf Course & Amenity Rules

• All guests must follow posted rules at the golf course, pool, and common areas
• Children under 14 must be supervised by an adult in the pool area
• No glass containers in pool area
• Proper golf attire is required on the course
• Golf carts must remain on designated paths
• Use of all amenities is at your own risk

Parking

Each unit includes designated parking. Oversized vehicles, trailers, and RVs must be pre-approved. Please do not park in fire lanes or block other guests.

Guest Responsibilities

Damage & Liability

Guests are financially responsible for any damage to the unit or resort property beyond normal wear and tear. Please report any damage or maintenance issues immediately. We reserve the right to charge the credit card on file for damages discovered after checkout.

Checkout Requirements

Before checking out, please:

• Wash and put away dishes
• Bag and remove trash to the designated dumpster
• Leave used towels in the bathroom
• Return furniture and remotes to their original positions
• Close and lock all windows and doors
• Turn off lights and HVAC
• Return keys (if applicable)

Units left excessively dirty or requiring extensive cleaning beyond normal turnover may incur an additional cleaning fee.

Lost & Found

We are not responsible for items left behind. If you believe you left something, contact us within 7 days. We will attempt to locate the item and arrange return shipping at your expense.

Long-Term Rentals

Monthly and extended-stay rentals are subject to a separate lease agreement. Terms including security deposit, rent due dates, lease duration, and termination policies will be provided during the application process. Contact our leasing office for details.

Events & Group Bookings

Corporate retreats, weddings, and group events are subject to separate event agreements with specific terms regarding deposits, cancellation, catering, and use of facilities. Contact us directly to discuss your event needs.

Commercial Use

No commercial photography, filming, or events are permitted on the property without prior written approval from management.

SMS Text Messaging Terms

By providing your mobile phone number to Apple Mountain Resort & Golf Club, you agree to the following SMS terms:

• Program Description: Apple Mountain Resort & Golf Club sends operational text messages including missed-call alerts to staff, booking confirmations, check-in instructions, leasing follow-ups, event and wedding coordination, service updates, and responses to guest inquiries.
• Consent: By providing your phone number through our website, reservation process, leasing application, event inquiry, or directly to our staff, you consent to receive text messages from Apple Mountain Resort & Golf Club at the number provided. Consent is not a condition of any purchase.
• Message Frequency: Message frequency varies based on your activity and the nature of the communication.
• Message and Data Rates: Message and data rates may apply. Check with your mobile carrier for details about your plan.
• Opt-Out: Reply STOP to any message to unsubscribe. You will receive one confirmation message and no further messages will be sent, except as required to respond to transactional requests you initiate.

• Supported Carriers: Our messaging program is compatible with major U.S. carriers, including AT&T, Verizon, T-Mobile, and Sprint. Carriers are not liable for delayed or undelivered messages.

Limitation of Liability

Apple Mountain Resort & Golf Club, its owners, operators, employees, and agents shall not be held liable for any injury, loss, damage, or expense arising from:

• Your stay at the resort or use of any amenities, including the golf course, pool, and common areas
• Loss or theft of personal property
• Weather-related disruptions, natural disasters, or other force majeure events
• Actions or negligence of other guests or third parties
• Interruption of utilities or services beyond our reasonable control

Our total liability for any claim arising from your use of this website or stay at our property shall not exceed the total amount you paid for your reservation. This limitation applies except where caused by our gross negligence or willful misconduct.

Intellectual Property

All content on this website, including but not limited to text, images, graphics, logos, videos, and design elements, is the property of Apple Mountain Resort & Golf Club or its licensors and is protected by United States and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, display, or create derivative works from any content on this website without our prior written consent.

Indemnification

You agree to indemnify, defend, and hold harmless Apple Mountain Resort & Golf Club, its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your stay at the resort, including any damage to property

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our website or services shall be resolved exclusively in the state or federal courts located in Habersham County, Georgia. By using this website, you consent to the jurisdiction and venue of such courts.

Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
